General Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all contracts between Sirka Sander (texts and translations) and her clients. By placing an order, the client accepts these terms. Deviating terms and conditions shall only apply if expressly agreed in writing.

 

2. Orders and Client Obligations

Orders may be placed in writing or electronically. A contract is concluded upon written confirmation. The client shall provide all information necessary for proper execution of the assignment (e.g. purpose, terminology preferences, delivery deadline). We are not liable for delays or defects resulting from unclear, incomplete or incorrect source texts or instructions.

3. Use of Third Parties

Qualified third parties may be engaged where appropriate. Responsibility towards the client remains with Sirka Sander.

 

4. Fees and Additional Work

All quotations are non-binding. Fees are stated in Euro and are net amounts, unless otherwise agreed. The quotation applies exclusively to the documents submitted by the client. Any subsequently submitted documents, amendments or additional text shall be invoiced separately. For larger assignments, advance payment may be agreed.

 

5. Delivery

Delivery dates are estimates unless expressly agreed as binding. Delivery is deemed effected once the translation has been sent electronically or dispatched by post.

 

6. Liability

Translations and texts are prepared with due professional care. Complaints must be submitted in writing within five working days of delivery. The client must describe the defect precisely. The right to remedy shall be granted first. Liability is limited to the value of the respective order, except in cases of intent or gross negligence. No liability is accepted for damages resulting from incorrect or incomplete information provided by the client.

 

7. Payment Terms

Invoices are payable within 14 days of the invoice date without deduction. In case of late payment, statutory default interest shall apply.

 

8. Copyright and Use

The translations and texts remain the property of Sirka Sander until full payment has been received. Rights of use transfer upon full payment.

 

9. Confidentiality and Data Protection

All texts and information provided by the client shall be treated confidentially. To support terminology work, quality assur-ance and efficiency, digital tools may be used. Where possible, personal data will be processed in anonymised form. Personal data shall be processed in accordance with applicable data protection laws.

 

10. Applicable Law

German law shall apply. The place of jurisdiction, where legally permissible, shall be Berlin, Germany.
